Welcome to Hucksters!
These Terms of Service ("Terms") govern your access to and use of the Hucksters social networking website, API, applications and associated services (collectively referred to as the "Platform") including any event information such as title and description texts, event dates, times and recurrences, graphics, photos or other materials uploaded, downloaded or appearing on the Platform (collectively referred to as “Content”). By accessing or using the Platform, you agree to these Terms.

A. The Services are Available “AS‑IS”
Please read these Terms carefully before using the Platform. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.
To use the Platform, you must be at least 18 years old. By using the Platform, you represent and warrant that you meet these eligibility requirements.
To access certain features of the Platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to use the Platform in compliance with applicable laws and these Terms. Prohibited activities include, but are not limited to:
Posting illegal or fraudulent Content.
Posting content that violates intellectual property rights.
Posting Content that violates local laws.
Violation of the above rules will cause termination or suspension of your account without prior notice.
Hucksters Inc. has a zero-tolerance policy regarding Child Sexual Abuse and Exploitation (CSAE). We are committed to maintaining a safe environment for all users of the Hucksters app. We utilize a combination of filters and manual moderation to detect and report such content.
We reserve the right to terminate or suspend accounts that violate these Terms, or for any other reason. Users may appeal such decisions through the designated process.
All events Content, whether publicly posted or privately posted, is the sole responsibility of the person who originated such Content. We may not monitor or control the Content posted on the Platform, and we cannot take responsibility for such Content. When creating or sharing events on the Platform, you agree to adhere to the following guidelines:
Abide by the laws of the jurisdiction you reside under
Provide accurate and up-to-date event information.
Respect intellectual property rights when posting event content.
Violation of the above rules will cause termination or suspension of your account without prior notice.
We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Platform. You understand that by using the Platform, you may be exposed to Content that might be inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabelled or are otherwise deceptive. Under no circumstances will Huckster be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Services or broadcast elsewhere.
We reserve the right at all times (but will not have an obligation) to remove or refuse to distribute any Content on the Platform, to suspend or terminate accounts, and to reclaim usernames without liability to you. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to:
satisfy any applicable law, regulation, legal process or governmental request;
enforce the Terms, including investigation of potential violations hereof;
detect, prevent, or otherwise address fraud, security or technical issues;
respond to user support requests, or (v) protect the rights, property or safety of the Platform, its users and the public.
Hucksters respects the intellectual property rights of others and expects users of the Platform to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us.
You retain your rights to any Content you post on the Platform. By submitting or posting Content on the Platform you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed).
Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the terms of the Privacy Policy.
You may not do any of the following while accessing or using the Services:
access, tamper with, or use non-public areas of the Services, Hucksters network or computer systems;
probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures;
access or search or attempt to access or search the Services by any means (automated or otherwise), unless you have been specifically allowed to do so in a separate agreement with Hucksters (NOTE: crawling the Services is permissible if done in accordance with the provisions of the robots.txt file, however, scraping the Services without the prior consent of Hucksters is expressly prohibited);
forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive or false source-identifying information; or
interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, mailbombing the Services, or by scripting the creation of Content in such a manner as to interfere with or create an undue burden on the Services.
Hucksters owns all rights to its content (excluding Content provided by users), trademarks, and intellectual property. Users may not use, copy, or reproduce such property without permission. The Services are protected by copyright, trademark, and other laws of both Canada and foreign countries.
Nothing in the Terms gives you a right to use the Hucksters name or any of the Hucksters trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding features and operation the Platform, or the Services is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.
The Terms will continue to apply until terminated by either you or Hucksters as follows. You may end your legal agreement with Hucksters at any time for any or no reason by deactivating or deleting your accounts and discontinuing your use of the Platform. You do not need to specifically inform Hucksters when you stop using the Platform. If you stop using the Platform without deactivating or deleting your accounts, your accounts may be deactivated or deleted due to prolonged inactivity at the discretion of Hucksters.
We may suspend or terminate your accounts or cease providing you with all or part of the Platform Services at any time for any or no reason, including, but not limited to, if we reasonably believe:
You have violated these Terms; or,
You create risk or possible legal exposure for us; or,
Our provision of the Platform to you is no longer commercially viable. We will make reasonable efforts to notify you by the email address associated with your account or the next time you attempt to access your account.
In all such cases, the Terms shall terminate, including, without limitation, your license to use the Platform, except that the following sections shall continue to apply: 5, 9, 11, 12, 13, 14, and 15.
Nothing in this section shall affect Hucksters’ rights to change, limit or stop the provision of the Platform without prior notice, as provided above in section 1.
Nothing in this section is intended to limit any rights you may have which may not be lawfully limited.
You understand and agree that the Platform is provided to you "as is" and “as available” basis. Hucksters make no warranty or representation and disclaim all responsibility and liability for: (i) the completeness, accuracy, availability, timeliness, security or reliability of the Services or any Content; (ii) any harm to your computer system, loss of data, or other harm that results from your access to or use of the Services or any Content; (iii) the deletion of, or the failure to store or to transmit, any Content and other communications maintained by the Platform; and (iv) whether the Platform will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from the Hucksters or through the Platform, will create any warranty or representation not expressly made herein.
The Platform may contain links to third‑party websites or resources. You acknowledge and agree that the Hucksters are not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by Hucksters of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HUCKSTERS SHALL NOT BE LIABLE FOR ANY INJURIES, LOSSES OR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD‑WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM (iii) ANY CONTENT OBTAINED FROM THE PLATFORM; OR (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF HUCKSTERS EXCEED THE AMOUNT YOU PAID HUCKSTERS, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.
THE LIMITATIONS OF THIS SUBSECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT HUCKSTERS HAVE BEEN INFORMED
To the maximum extent permitted by applicable law, you agree to release, defend (at Hucksters’ option), indemnify, and hold Hucksters harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (i) your breach of these Terms (ii) your improper use of the Platform, (iii) your interaction with any user, including without limitation any injuries, losses or direct, incidental, compensatory, consequential, punitive or otherwise damages of any kind arising in connection with or as a result of such interaction, attendance, or participation, or (v) your breach of any laws, regulations, or third-party rights such as intellectual property or privacy rights.
These Terms are governed by the laws of province of British Columbia, Canada. Any disputes shall be resolved through arbitration, or mediation in British Columbia, Canada.
